Terms and Conditions of Best-Bedding.com, established in Moordrecht (version valid from 01-01-2022)

Article 1. General
1.1 In these general terms and conditions, ‘Best-Bedding.com’ shall be understood to mean: Best-Bedding.com.
1.2 These terms and conditions form part of all offers and agreements with Best-Bedding.com, unless expressly deviated from in writing.
1.3 Subject to the provisions of Article 6.4, these terms and conditions also apply if Best-Bedding.com must engage third parties for the execution of any agreements.
1.4 Unless agreed otherwise in writing, Best-Bedding.com does not accept general or specific terms and conditions from third parties.
1.5 In the event that the Terms and an Agreement contain conflicting clauses, the Agreement shall prevail.
1.6 If any provision of the Terms is null and void or annulled, the remaining provisions shall remain fully effective. The parties shall then make every effort to jointly agree on a valid replacement clause that approximates the original intent as closely as possible.
Article 2. Offers and Formation of Agreements
2.1 All offers are without obligation unless expressly stated otherwise by Best-Bedding.com.
2.2 Agreements for the delivery of goods and/or services only bind Best-Bedding.com after written confirmation. Actual performance by Best-Bedding.com or an invoice sent by Best-Bedding.com is considered equivalent to written confirmation of the offer.
2.3 If the accuracy of this written confirmation is not disputed in writing within 8 days, both Best-Bedding.com and the buyer are bound by it.
2.4 Offers from Best-Bedding.com do not automatically apply to repeat orders.
2.5 Best-Bedding.com cannot be held to an offer if the buyer should reasonably understand that the offer, or part thereof, contains an obvious mistake or clerical error.
2.6 Supplements, amendments and/or additional agreements are only valid if agreed in writing.
Article 3. Prices / Price Increases
3.1 All prices are expressed in Euros and include VAT, unless stated otherwise.
3.2 Best-Bedding.com guarantees that no price increases will occur after the conclusion of the agreement, unless the increase is the result of statutory regulations or provisions.
3.3 If the price increase is not the result of statutory regulations or provisions, the consumer has the right to terminate the distance agreement on the day the price increase takes effect.
Article 4. Delivery
4.1 If items are in stock, they will be shipped immediately after the order is placed. Best-Bedding.com may charge shipping costs for ordered items. Delivery occurs at the postal address known to Best-Bedding.com, provided it is not temporary, and will be handed over to the natural person present at the delivery address.
4.2 The buyer must sign for receipt of the products, unless they have legal grounds for refusal.
4.3 If the buyer refuses delivery or fails to provide information or instructions necessary for delivery, the items will be stored at the buyer’s expense and risk.
4.4 Delivery obligations of Best-Bedding.com are fulfilled once the goods have been offered once to the buyer, unless proven otherwise. In case of home delivery, the carrier’s report indicating refusal of acceptance constitutes full proof of the delivery attempt, unless proven otherwise.
4.5 In case of refusal of delivery, return shipping and storage costs, as well as the risk of damage or loss, are entirely borne by the buyer, unless the buyer rightfully invokes dissolution of the purchase or replacement of the item.
Article 5. Delivery Time
5.1 A delivery time stated by Best-Bedding.com is never a strict deadline. The delivery time begins only after all required information is in the possession of Best-Bedding.com. Best-Bedding.com will then attempt to deliver within 30 days.
5.2 In accordance with the rules of distance purchasing, Best-Bedding.com shall execute orders with due speed and at least within 30 days. If this is not possible (due to lack of stock or other delays), or if an order cannot or can only be partially fulfilled, the consumer will be notified within 1 month after placing the order. In such cases, the consumer is entitled to cancel the order free of charge.
Article 6. Dissolution
6.1 Without prejudice to statutory rights, Best-Bedding.com is entitled to suspend or dissolve the agreement in whole or in part by written notice if circumstances arise after the agreement that give reasonable grounds to fear that the buyer will not fulfil obligations, or if requested security is insufficient, or in the event of bankruptcy, suspension of payment, liquidation, transfer of the business, or seizure of assets.
6.2 If circumstances arise concerning persons and/or materials used by Best-Bedding.com that render execution impossible or excessively burdensome, Best-Bedding.com may dissolve the agreement.
6.3 The consumer has the right to dissolve the agreement within 14 working days without reason (distance purchase), unless expressly agreed otherwise. This period begins on the date of delivery. If the buyer does not return the goods within this period, the purchase becomes final. The buyer must notify Best-Bedding.com of the return within 14 working days. Return shipment is at the buyer’s expense and risk. Goods must be returned in original packaging, unused, complete and in new condition. If used or damaged, the right to dissolution expires. After proper receipt and inspection, Best-Bedding.com will refund the full purchase amount within 30 days.
6.4 The right of dissolution described above applies only to goods, and never to services such as telephone subscriptions offered by network operators. Those services are subject to the operator’s general terms.
Article 7. Force Majeure
7.1 Force majeure includes all external causes beyond the control of Best-Bedding.com that hinder delivery, including but not limited to strikes at Best-Bedding.com or suppliers, Internet/WAP failures, electricity failures, email disruptions, and technological issues caused by third parties.
7.2 Force majeure may be invoked even if the circumstances occur after Best-Bedding.com should have fulfilled its obligations.
7.3 If force majeure lasts longer than 2 weeks, both parties may dissolve the agreement, with no obligation to pay damages.
7.4 If Best-Bedding.com has fulfilled part of its obligations at the time force majeure occurs, it is entitled to invoice the delivered or deliverable part separately.
Article 8. Warranty
8.1 Best-Bedding.com offers no broader warranty than the manufacturer’s warranty, without affecting the buyer’s statutory rights.
8.2 Best-Bedding.com is never responsible for the suitability of goods for any individual purpose, nor for (usage) advice.
8.3 The buyer must inspect the delivered goods immediately upon receipt. Any defects must be reported in writing before returning. Defects must be reported within 2 months of delivery. Goods must be returned unused, complete, undamaged and in original packaging.
8.4 If a complaint is justified, Best-Bedding.com will replace the item or agree on compensation, limited to the invoice amount or the maximum insured amount. No liability exists for indirect damage, consequential damage or loss of profit.
8.5 Best-Bedding.com is not liable for damage caused by intent or deliberate recklessness of non-management employees.
8.6 Warranty does not apply if:
A) the buyer is in default;
B) the buyer or third parties have repaired/modified the goods;
C) the goods were exposed to abnormal conditions or handled contrary to instructions;
D) defects result from government regulations regarding materials or quality requirements.
Article 9. Payment
9.1 Unless otherwise agreed, payment must be made by PIN transaction at the place of delivery. Partial payments are not allowed.
9.2 After 10 days from the invoice date, the buyer is legally in default and owes 1% interest per month unless statutory interest is higher.
9.3 In case of bankruptcy or suspension of payment, claims from Best-Bedding.com become immediately due.
9.4 If Best-Bedding.com must outsource collection of payment, the buyer owes a fixed fee of 15% (minimum €250).
9.5 If Best-Bedding.com can demonstrate higher necessary costs, these may also be charged.
Article 10. Retention of Title
10.1 All delivered goods remain the property of Best-Bedding.com until all obligations have been fulfilled.
10.2 Goods under retention of title may only be resold in the normal course of business, and may never be used as payment.
10.3 The buyer may not pledge or encumber these goods.
10.4 The buyer grants Best-Bedding.com permission to enter all premises where the goods are located and reclaim them.
10.5 If third parties attempt to seize the goods, the buyer must notify Best-Bedding.com immediately.
10.6 The buyer must insure the goods against fire, water damage, explosion and theft and present the policy upon request.
Article 11. Privacy
11.1 Best-Bedding.com respects the privacy of online visitors and is the sole owner of information obtained via the website, unless stated otherwise. This information is not sold, shared or rented except as described in this privacy statement.
11.2 Personal data voluntarily provided may be used internally to improve website experience, analysis, or to provide information about the product portfolio. Best-Bedding.com may disclose information when necessary to identify or act against individuals who harm the rights or property of Best-Bedding.com or others. Information may be disclosed when required by law.
11.3 Best-Bedding.com collects non-personal data (browser type, operating system, visitor numbers). Personal data may be deleted upon request if this does not require disproportionate effort.
Article 12. Intellectual Property Rights
12.1 Unless agreed otherwise in writing, all copyrights and other intellectual or industrial property rights relating to goods or services supplied by Best-Bedding.com belong exclusively to Best-Bedding.com and/or its suppliers.
12.2 Parties shall take appropriate measures to maintain confidentiality.
Article 13. Applicable Law
13.1 All offers and agreements of Best-Bedding.com are governed exclusively by Dutch law. The applicability of the Vienna Sales Convention is expressly excluded.
Article 14. Disputes
14.1 For questions or complaints, the buyer may contact Best-Bedding.com’s Customer Care helpdesk at +3185-7609235, available Monday–Friday from 8:30 to 17:00. Complaints are usually handled within 30 days. If this is not possible, the buyer will be informed.
14.2 The buyer may submit a dispute to an independent dispute committee such as the Thuiswinkel Disputes Committee or an equivalent body, without prejudice to the buyer's right to submit the matter to a competent court.
Placing an order
When you place an order at Best-Bedding.com, a carefully coordinated process begins behind the scenes. Immediately after completing your purchase, you will receive a confirmation email containing a full overview of your order. Once your payment has been successfully processed, your order is officially confirmed and we start preparing everything for dispatch.
At that moment, we check your order, reserve the items in our system and notify our logistics partners. You can expect to be kept informed at every step — from processing to shipping. As soon as your order is ready to be dispatched, you will receive a shipping confirmation with a track & trace code, allowing you to follow your parcel all the way to your doorstep.
If you wish to make changes or cancel your order after placing it, this is possible as long as the order has not yet been shipped. In that case, please contact our customer service as quickly as possible so we can assist you. In rare cases, Best-Bedding.com may need to refuse or cancel an order — for example, if a product unexpectedly becomes unavailable or if a payment has not been completed correctly. Should this happen, you will be informed immediately and the full amount will be refunded.

Delivery
At Best-Bedding.com, we do everything we can to ensure your order is delivered quickly and smoothly. Once your order has been processed, it is carefully prepared for shipment through our trusted carriers. During checkout, you’ll see which delivery options are available for your address and the expected delivery time. In most cases, your order will be delivered the next business day.
As soon as your parcel leaves our warehouse, you’ll receive a shipping confirmation with a track & trace link, allowing you to follow your delivery every step of the way. Please note that external factors — such as carrier delays, weather conditions or public holidays — can occasionally affect delivery times. Of course, we will always keep you informed about the status of your order.
At Best-Bedding.com, we aim to deliver your new bedding quickly, safely and with care, so you can look forward to wonderful nights of comfort.
Returns & Refunds
You have the right to return your order within 14 days of receiving it, without giving any reason. We accept returns of both defective and non-defective products. In that case, you will receive a refund of the full order amount, excluding shipping costs. The return shipping costs from you to Best-Bedding.com are at your own expense.
If you make use of your right of withdrawal, the product must be returned to us with all supplied accessories and, if reasonably possible, in its original condition and packaging. To exercise this right, you can contact us at sales@best-bedding.com. We will refund the amount due within 14 days after you have registered your return, provided that we have received the product back in good condition.
